Terms of Service

Introduction
These Terms of Service govern access to and use of Bifalabs websites, applications, candidate evaluation tools, AI interview workflows, proctoring services, recruiter dashboards, APIs, analytics, and related services. By creating an account, accessing an assessment, purchasing a subscription, inviting candidates, or otherwise using the Services, a user or organization agrees to be bound by these Terms.
About Bifalabs
Bifalabs provides workforce readiness, candidate vetting, AI-assisted interviewing, assessment integrity, proctoring, skills intelligence, and hiring workflow infrastructure. The Services are designed to help candidates demonstrate readiness and help organizations evaluate job-related signals more consistently. Bifalabs does not guarantee employment outcomes, hiring decisions, candidate performance, job placement, or business results.
User Roles
The Services may support candidates, employers, recruiters, staffing organizations, training partners, platform administrators, and other authorized users. Each user is responsible for using the Services only for lawful, authorized, and intended purposes. Employer and recruiter users are responsible for ensuring that their hiring practices, notices, consent flows, accommodations, evaluation criteria, and employment decisions comply with applicable law.
Accounts and Credentials
Users must provide accurate account information and maintain the confidentiality of their credentials. Bifalabs may suspend or restrict accounts where it reasonably believes there is unauthorized access, fraud, misuse, data security risk, policy violation, nonpayment, or legal exposure. Users must promptly notify Bifalabs if they suspect account compromise.
Assessment Use
Bifalabs assessments, AI interview outputs, proctoring signals, integrity scores, skill-gap results, learning recommendations, and candidate summaries are decision-support tools. They are not a substitute for employer judgment, structured review, job-related validation, or legally required individualized assessment. Employers should not use Bifalabs outputs as the sole basis for a material employment decision without appropriate human review.
Proctoring and Integrity
Certain Services may require webcam, microphone, screen sharing, browser activity monitoring, identity verification, event logging, or other assessment integrity controls. Candidates may be required to provide consent and complete device checks before starting a proctored session. Bifalabs may flag, suspend, terminate, or invalidate sessions where suspicious activity, technical interference, impersonation, policy violations, or integrity risk is detected.
AI Features
The Services may use artificial intelligence and machine learning to generate interview questions, summarize responses, identify potential skills gaps, detect proctoring anomalies, rank readiness signals, or assist with employer review. AI outputs may be incomplete, inaccurate, or affected by context. Users should review AI outputs critically and apply appropriate human judgment.
Customer Data
Users retain ownership of data they submit, subject to the limited rights Bifalabs needs to host, process, transmit, analyze, secure, support, and improve the Services. Customers are responsible for ensuring they have all rights, consents, notices, and lawful bases required to submit candidate or employee data to Bifalabs.
Subscriptions and Fees
Paid Services may be offered through subscriptions, usage-based plans, enterprise agreements, candidate premium plans, add-ons, or other commercial arrangements. Fees, renewal terms, usage limits, cancellation rights, and support levels will be described in an order form, checkout page, subscription plan, or written agreement. Unless otherwise stated, subscriptions renew automatically until canceled under the applicable plan terms.
Acceptable Use
Users may not cheat, impersonate others, manipulate assessments, reverse engineer the Services, scrape data, bypass security controls, interfere with monitoring, upload malware, misuse candidate data, violate privacy rights, or use the Services for unlawful discrimination, harassment, surveillance outside permitted contexts, or other harmful activity.
Intellectual Property
Bifalabs owns or licenses all platform software, workflows, user interfaces, scoring logic, models, documentation, trademarks, content, and other intellectual property associated with the Services. Except for rights expressly granted, no ownership or license is transferred to users.
Disclaimers and Limitations
The Services are provided on an as-is and as-available basis to the fullest extent permitted by law. Bifalabs disclaims warranties of uninterrupted operation, error-free performance, fitness for a particular purpose, and accuracy of AI outputs. To the fullest extent permitted by law, Bifalabs will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Bifalabs aggregate liability will not exceed the amounts paid for the Services during the twelve months preceding the claim unless a separate written agreement states otherwise.
Termination
Bifalabs may suspend or terminate access for violations of these Terms, security risk, nonpayment, fraud, misuse, legal requirement, or platform protection. Upon termination, access to the Services may end immediately, but provisions relating to confidentiality, payment obligations, intellectual property, data protection, disclaimers, limitation of liability, and dispute resolution will survive.
